Continuing to track rain/snow showers throughout southeast Colorado this morning as wet, gloomy and cool conditions continue. If you are hitting the roads in the higher elevation (Teller/Fremont/Custer/ Monument) make sure you allow a little extra time as some roads may be a little snow covered. Two women who say they were raped by University of Colorado football players or recruits plan to appeal a judge's dismissal of their lawsuit against the school.
Attorney Baine Kerr says he also may file motions asking the judge to reconsider.
Thursday U.S. District Judge Robert Blackburn tossed complaints filed by Lisa Simpson and another woman -- who alleged CU violated federal Title Nine laws by fostering an environment that led to the alleged assaults.
No criminal rape charges have been filed.
Kerr says he plans to challenge Blackburn's ruling that the women failed to prove CU had actual knowledge of sexual harassment by football athletes, and that they failed to show the school was deliberately indifferent to harassment.
The appeal would be filed with the Tenth U.S. Circuit Court of Appeals.
