A 34-year-old woman charged with drowning her two children may be fooling the justice system.
That's the feeling of the grandmother of one of the children. Carmen Amaya says it looks like the mother is getting away with murder.
Prosecutors have decided not to try Rebekah Amaya for murder in the deaths of her four-year-old daughter and five-month-old son -- who drowned in a bathtub. They say couldn't prove beyond a reasonable doubt that the mother was sane at the time.
She had pleaded not guilty by reason of insanity to two counts of first-degree murder.
The trial was set for January 31st. Instead, Rebeka Amaya is expected to tell the judge that day that she killed her children. She faces an indeterminate commitment to the Colorado Mental Health Institute in Pueblo.
Grandmother Carmen Amaya thinks the younger woman is pretending to be insane and says she has ruined a lot of lives.
