State Attorney General Says Medical Marijuana Subject to Taxes

Colorado Attorney General John Suthers has issued a formal opinion saying medical marijuana is subject to state and local taxes.
The opinion issued Monday says only seeds would be exempt from sales tax in Colorado. Otherwise, it would be up to vendors to collect and remit sales tax on other forms.
Suthers says medical marijuana is considered personal property that can be taxed. He says it doesn't qualify as a prescription drug that would be tax exempt, and it doesn't generally qualify for agricultural tax exemptions. Retailers must have a state retail sales license.
An amendment approved by Colorado voters in 2000 allows marijuana use for "debilitating medical conditions," but marijuana remains illegal under federal law.

I agree with Robert, they can not tax it unless they legalize in the state. That includes places like Denver and Breckenridge that decriminalized it. Just because it's decriminalized in those towns they still can not tax it until it is legalized. Now is your chance Colorado to set the pace for legalization and taxation, and it should be regulated as alcohol(age limits etc). State economy is hurting you have a bumper crop of taxes that could be made and fill a lot of city budgets and promote economic growth at the same time. That just is common sense though, very few politicians have common sense though, and want to fuel a failed war full of blatant lies and proven false government medical studies.
Why not just keep it illegal for everyone. There are very few people who truly need medicinal marijuana. All the others are getting illegal prescriptions because it prevents them from being arrested for having it, basically a loophole in the law. But i totally agree with that why would it be "legal" to collect taxes on something that it is illegal to possess and transfer, according to city and state laws.
Question, How can the State collect taxes on the sale of something that is not legal to sell for profit? The moment the state collects taxes it becomes a "PARTY TO THE CRIME" if the state wants to collect taxes, it must 1st make Cannabis LEGAL for everyone, since the State wants to collect taxes in the name of the people of the State of Colorado. I have no problem with taxation on a legal substance, therefore if it is legal then it should fall under medicine and should be taxed and the health insurance companies should also pay for this medicine as well...who are we kidding here with this Medical Marijuana FAD/TREND?....its easy to try and claim taxation....but in America there should be NO TAXATION WITHOUT REPRESENTATION plain and simple..Why would the Blackmarket ever pay taxes of its own free will?? The only reason that the prices are so high is because it is not legal, taxation based on blackmarket prices and supplies?? get real....Tax? so far from reality.......happy 420!
