3rd arrest made in fatal liquor store holdup

COLORADO SPRINGS, Colo. (KKTV) - Police have announced a third arrest in the slaying of a liquor store owner earlier this year.

Donat Herr, 67, was shot during a robbery at his store just after midnight on Feb. 15. Four teens were arrested in for the robbery itself, but previously just two of the robbery suspects were charged in the shooting. Wednesday, Springs police said a 16-year-old boy was now facing first-degree murder charges.

Only one of the alleged shooters, 18-year-old Phinehas Daniels, has been identified. Along with the most recent arrestee, the other suspect, at just 13 years old, is considered too young for his name to be released.

The suspects had allegedly been involved in six robberies before the liquor store holdup and had never used their weapons until that night.

The investigation is ongoing.
